The problem

What is excess area?

It occurs when the real surface of a property —measured on the ground— is greater than that registered in the Property Registry. It is more frequent than it seems: rural plots, old farms, undeclared construction extensions or historical measurement errors.

The Registry collects what was drafted back then, not necessarily the current physical reality. Over the years, that gap becomes a legal and economic obstacle.

Key rule

A difference greater than 10% of the registered area requires a complex notarial procedure with georeferencing and notification to neighbors. Below 10%, the procedure is more agile.

Renovation or extension that added square meters without updating the Registry. The buyer discovers upon signing that the deed does not match reality.

Rural farm or plot

Old measurements with less precise instruments. Modern cadastral georeferencing reveals larger surfaces than those registered decades ago.

Georeferenced topographic measurement

A certified surveyor surveys the farm with GPS technology and generates the GML file required by the Mortgage Law for cadastral coordination. Without this step, the Registry cannot accept the rectification.
